Earlier in the summer we reported that Ningbo Xinyue Instrument Co., Ltd, a Chinese manufacturer of metrology inspection machines, was fined for installing used Navitar optics after having previously advertised that its machines included new video microscope lenses. Now, another Chinese metrology machine maker, Shenzhen Zhongtian Shidai Science & Technology Co., Ltd., has also been fined for falsely advertising the fact that their machines included Navitar video microscope lenses, when in fact, they did not.
Shenzhen Zhongtian Shidai Science & Technology Co. was ordered by the Longgang Branch of Shenzhen Administrative Bureau for Market Supervision to immediately cease its illegal conduct of unfair competition and false advertising, as it violated Paragraph One of Article 9 of the Anti-unfair Competition Law of the People’s Republic of China. In accordance with this law, the bureau fined the company 10,000 RMB.
Navitar’s attorneys in China, Kangda Law Firm Shanghai Office, have enlisted the help of additional local Province AIC offices to take action against other Chinese metrology machine makers that are also engaging in false print and online advertising by stating their metrology machines include Navitar lenses, when they do not. These companies did not purchase lenses from Navitar or through a Navitar-authorized dealer in China, and are not authorized to utilize the brand in any manner, according to Navitar.
"The local AIC investigations are of great significance in the defense of Navitar’s intellectual property rights in China. This is the 3rd Chinese metrology machine maker that has been fined by local AIC offices for false advertising this year," said Julian Goldstein, Navitar’s President.
Goldstein added that the company will continue to identify and take swift legal action against other companies who falsely advertise their products, attempt to deceive and mislead the public, and compete unfairly against Navitar and its distributors.
